On July 21, 2004 Kiev Commercial Court ruled in favor of Olvia Corporation (Dnepropetrovsk, Ukraine) in its dispute with the State Department of Intellectual Property (Patent Office).
The plaintiff demanded cancellation of registration of NOVYI ZHEMCHUG trademark owned by Nevskaya Cosmetika (St Petersburg, Russia) on the basis of existence of its own trademark ZHEMCHUG («pearls»). Nevskaya Cosmetika filed counter-claim against Olvia Corporation that was dismissed by the court.
By the decision of the court registration of NOVYI ZHEMCHUG in Ukraine was canceled.
Olvia Corporation was represented by Ms. Tatiana Gluhovskaya, a patent attorney with Konnov & Sozanovsky.
