On May 31st, 2013, a meeting of initiators of creating the Club of mediation practices was held. Alexey Ivanov, Konnov & Sozanovsky managing partner, one of the idea authors, participated in the meeting, as well as representatives of the Ukrainian Mediation Center Galina Yeremenko and Vladimir Marukhevich, AstapovLawyers representative Oleg Gromovoi, and managing partner of “S. K. O. Forum” Elena Sapozhkova. Organization questions also involve participation of Sayenko Kharenko counsel Svetlana Kheda, Pavlenko & Poberezhnyuk partner Aleksandra Pavlenko, and Vasil Kisil & Partners partner Oksana Voynarovska.
It is planned that the Club of mediation practices will be acting in the frames of the Ukrainian Mediation Center, founded as a part of Kiev Mohyla Business School. Participants of the meeting confirmed the necessity to create such Club, discussed technical issues of realization of mediation process in the legal field, cooperation methods between the members and Mediation Center.
- Unfortunately, Ukrainian reality makes our clients doubt about objective outcome results of their case in court. Those who have practice of solving cases in courts are aware that it is quite a long and costly process. And even if the result is successful, there are doubts if the court’s decisions will be carried out, and how long it will take. Besides, there are cases that are not appropriate for court solving as they have strong ethic or moral component. In such situations, in my opinion, mediation process – solving disputes by a third independent part – will be most proper, - says Alexey Ivanov.
The Club is being organized to unite successful experienced lawyers, who can act as moderators while solving disputes. These lawyers must go through a special education course and obtain a special certificate.
- Mediation practice is well spread in the Western countries, including the legal sphere. Of course, there are cases that only court can solve. But if there is a more peaceful way I think we should inform our client. Mediation process will be an advantage for both a client and a law firm. A client will solve the conflict faster and with less financial loss. A law firm will have an opportunity to protect client’s interests in a more peaceful way, with less time and human resources expenses, - comments Alexey Ivanov.
The Club’s initiators believe in a successful prospective of the mediation practice on the Ukrainian market. During the next meeting, it is planned to approve the Club’s members and discuss opportunities of informing the public about legal mediation practice and the Club’s work.
